Permanent Residency Visa

Question: How to get Permanent Residence visa in Indonesia?

Answer: To get Permanent residence visa, the requirements and procedures are different from person to person, depending on who files it and his/her status in Indonesia as what. The complete explanation is as follows: According to the laws of immigration No. 6/ 2011 article 54 and article 60, for foreigners the holders of KITAS with his/her status as worker, clergy, investor and old in age, then they may file for Permanent residence visa/KITAP after residing for 3 consecutive years. While for foreigners married to Indonesian nationals, then they may file for Permanent residence visa after the length of marriage has reached 2 years. Likewise for husbands, wives or children of foreigner who has had Permanent residence visa/KITAP then they may directly file for Permanent residence visa/KITAP . In particular for foreigners who formerly Indonesian nationals and formerly subject as the children of dual nationalities then they get greater priority and may directly file for Permanent residence visa. While in accordance to Laws No. 6 /2011 article 54, stating that foreigners the Holders of Permanent residence visa / KITAP have already become Indonesian residents and shall obtain greater facility compared to foreigners the holder of KITAS or other kind of visa. For example, the Holder of Permanent residence visa shall obtain foreign KTP (Indonesian Resident ID Card) just like an Indonesian, whereas this KTP is not possible to be obtained by foreigners the holders of other type of visa such as KITAS etc. Indeed, actually from time to time the existing policy change and amendments on Indonesian immigration regulations significantly have given many facilities and conveniences to foreigners the holders of Permanent residence visa / KITAP and more so in the future.
Concerning the requirements that must be made read are different for each applicant, depending on who and what is the status at the time of applying.

If the applicant is a husband/wife married to Indonesian national then the requirements are as follows:

Requirements:

  1. Photocopy of passport with 18 months minimum validity.
  2. Photocopy of KITAS
  3. Photocopy of Blue Book.
  4. Photocopy of KTP (Indonesian Resident Identity Card)
  5. Photocopy of and KK (Indonesia Family Registry) of Indonesian National Husband/Wife if already married to Indonesian National.
  6. Photocopy of Marriage Certificate if already married to Indonesian National.
  7. Photo with red color background.

If the applicant with the status as worker or investor and holder of working KITAS then the documents to be attached at the time of applying are as follows:

Requirements:

  1. Photocopy of passport with 18 months minimum validity.
  2. Photocopy of KITAS of KITAS I to KITAS 5/6.
  3. Photocopy of Blue Book.
  4. Photocopy of the latest work permit/IMTA.
  5. Photocopy of still valid RPTK.
  6. Photocopy of KTP (Indonesian Resident Identity Card) and KK (Indonesia Family Registry) of Indonesian National Husband/Wife if already married to Indonesian National.
  7. Photocopy of Marriage Certificate if already married to Indonesian National.
  8. Photo with red color background.

Question:  May a foreigner the holder of KITAS/KITAP married to Indonesian work?

Answer: In accordance to the immigration regulation No. 6 / 2011 article 61, that a foreigner the Holder of KITAS in article 52 letter e and for the Holder of Permanent residence visa / KITAP in article 54 letter b and d legally married to Indonesian National or the child of foreigner legally married to Indonesian national, may perform work and/or business to meet the needs of livelihood and / or the family.
